These Terms of Service (Terms) are a legal agreement between you and Martian Designs Ltd ("Munch Hutch", "we", "us") governing your use of the Munch Hutch website, mobile applications, and related services (the Service). Please read them carefully.
By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Definitions
- Account — your registered Munch Hutch login.
- Household — a group of users sharing one pantry, plan, and shopping list.
- Content — anything you add to the Service, including pantry items, photos, notes, and preferences.
- Premium — our paid subscription tier.
2. Eligibility
You must be at least 16 years old and able to form a binding contract to use the Service. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation to these Terms.
3. Your account
- Provide accurate information when registering and keep it up to date.
- You are responsible for keeping your password secure and for all activity under your account.
- Multi-factor authentication is enabled by default. Disabling it is your choice and your risk.
- Tell us immediately at support@pantrypal.org.uk if you suspect unauthorised access.
- Do not share your account. You may instead invite people into your household, where roles control what each member can see and change.
4. Not dietary, allergen, or medical advice
This is the most important section of these Terms. Please read it in full.
Munch Hutch is a meal planning and organisation tool. It is not a medical device, and nothing in the Service is medical, nutritional, or dietary advice.
- Allergen filters are a convenience, not a safety guarantee. Dietary labels are derived from recipe ingredient lists and third-party product data, which may be incomplete, out of date, or wrong. Recipes may be prepared near allergens, and manufacturers change formulations without notice.
- Always read the actual packaging of every product before eating it, especially if you or anyone in your household has a food allergy or intolerance. Never rely on Munch Hutch alone.
- Nutrition and calorie figures are estimates. Recipe macros are calculated from typical ingredient values and will differ from what you actually cook. Do not use them for clinical or medical purposes.
- Expiry and freshness prompts are reminders only. Use your own judgement about whether food is safe to eat, and follow standard food-hygiene practice.
- Consult a qualified doctor or registered dietitian before making significant dietary changes, and especially if you are pregnant, managing a medical condition, or feeding an infant.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.
5. Subscriptions, billing, and renewals
- Munch Hutch offers a free tier with usage limits and a paid Premium tier. Current prices are shown on our pricing page and include VAT where applicable.
- Payments are processed by Stripe. By subscribing you authorise recurring charges to your chosen payment method.
- Subscriptions renew automatically at the end of each billing period (monthly or yearly) until cancelled.
- You can pause or cancel at any time from your account settings. Cancelling stops future charges; you keep Premium access until the end of the period you have already paid for.
- We may change prices with at least 30 days' notice by email. Price changes never apply to a period you have already paid for. If you do not accept a new price, cancel before it takes effect.
- Promotional pricing (such as launch discounts) applies for the stated period only, after which the standard rate applies.
- If a payment fails we may retry it and may suspend Premium features until payment succeeds.
6. Your right to cancel (UK/EU consumers)
If you are a consumer in the UK or EEA, you normally have 14 days from purchase to cancel a subscription for a refund. By starting to use Premium features immediately, you acknowledge that the service begins during the cancellation period and that your right to cancel ends once the service has been fully performed. In practice we take a fair approach: if you cancel within 14 days and have made little or no use of Premium, contact support@pantrypal.org.uk and we will refund you.
7. Acceptable use
You agree not to:
- Break any law, or infringe anyone's rights, using the Service.
- Reverse engineer, decompile, scrape, or attempt to extract our source code or datasets.
- Probe, disrupt, or overload our infrastructure, or bypass rate limits and access controls.
- Resell, sublicense, or commercially redistribute the Service without our written permission.
- Upload malware, or content that is unlawful, abusive, hateful, or obscene.
- Submit photos of other people without their permission.
- Create accounts by automated means, or manipulate Pantry Points or rewards.
- Misrepresent your identity or your authority to act for a household.
We may suspend or terminate accounts that breach this section, and may remove content that does.
8. Your content
You keep ownership of your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, process, and display it strictly to operate and improve the Service for you. This licence ends when you delete the Content or your account, except where we must retain records by law.
You confirm you have the rights to any Content you upload and that it does not infringe anyone else's rights.
9. Our intellectual property
The Service, including its software, design, branding, recipe catalogue, and curated content, is owned by Martian Designs Ltd and protected by intellectual property law. We grant you a limited, personal, non-transferable, revocable licence to use the Service for your own household's meal planning. All rights not expressly granted are reserved.
10. Rewards and Pantry Points
Pantry Points have no cash value, cannot be exchanged for money, and cannot be transferred between accounts. We may change point values, earning rules, and reward thresholds at any time. We may withhold or reverse points obtained through misuse, automation, or false meal-completion photos. Mystery kitchen drops are subject to availability and to any additional terms published with them.
11. AI-assisted features
Some features use artificial intelligence, including grocery recognition from photos, recipe recommendations, and the support assistant. AI output can be inaccurate or incomplete — it may misidentify an item, miss an ingredient, or give an imperfect answer. Always review AI output before relying on it, particularly where allergies are involved. We are not liable for decisions you make based solely on AI-generated output.
12. Third-party services
The Service integrates third-party providers (including Stripe, Google, OpenAI, Groq, Open Food Facts, and Pexels) and may link to third-party sites. We are not responsible for their content, availability, or practices, and your use of them is governed by their own terms.
13. Availability and changes
We aim for a reliable Service but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time. If we discontinue the Service entirely, we will give you reasonable notice and an opportunity to export your data, and will refund any prepaid period you cannot use.
14. Suspension and termination
- You may stop using the Service and delete your account at any time from your account settings.
- We may suspend or terminate your account if you materially breach these Terms, if required by law, or to protect the Service or other users. Where practical we will warn you first.
- On termination your licence ends immediately. Sections that by their nature should survive (including 4, 8, 9, 15, 16, and 19) continue to apply.
15. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that recipe data, nutrition estimates, pricing information, or dietary labels are accurate, complete, or current.
Nothing in this section affects your statutory rights as a consumer, which cannot be excluded.
16. Limitation of liability
Nothing in these Terms limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be limited.
Subject to that:
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill.
- Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) £100.
- We are not liable for loss or damage caused by events outside our reasonable control, or by your failure to follow the safety guidance in section 4.
17. Indemnity
If you are using the Service other than as a consumer, you agree to indemnify us against claims, losses, and reasonable costs arising from your breach of these Terms, your Content, or your misuse of the Service.
18. Changes to these Terms
We may update these Terms as the Service develops. For material changes we will give at least 30 days' notice by email or in-app. Continuing to use the Service after the change takes effect means you accept the updated Terms; if you do not accept them, you may cancel and delete your account.
19. Governing law and disputes
These Terms are governed by the laws of England and Wales. Disputes will be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer resident elsewhere in the UK or EEA, you keep the benefit of any mandatory protections and the right to bring proceedings in your local courts.
We would much rather resolve things directly — please contact support@pantrypal.org.uk first and we will try to sort it out.
20. General
- Entire agreement: these Terms and the Privacy Policy are the whole agreement between us.
- Severability: if any provision is found unenforceable, the rest remains in force.
- No waiver: not enforcing a right immediately does not waive it.
- Assignment: you may not transfer your rights without our consent; we may assign ours in connection with a merger or sale, without reducing your rights.
- Third parties: no one other than you and us has rights under these Terms.
